It's not completely without doubt that James Holmes was wearing a "bullet-proof" vest, but you already pointed out, if he wasn't, it would only make your argument stronger.

Another point, which actually seems likely from witness accounts of the shooting, is that James Holmes probably did NOT use tear gas, but some kind of relatively ineffective smoke bomb.

Thanks for your article.

That information came out after my article was published. But it makes my point stronger: someone else in the theater shooting back at James Holmes could have stopped him with a shot to center of body mass.

That "no armor" thing is another false internet rumor. Here is a photo of the stuff the police took off of him, a trauma plate holder with a rifle grade trauma plate, and a Kevlar helmet:

Paul Bonneau:

Agree with all points but this one:
“But by disarming its theater patrons Cinemark accepted legal liability for their safety, and the victims disarmed by these enablers need to sue this corporation into bankruptcy…”
No they didn’t assume any legal liability. Patrons had a choice, to use their services or not. The correct way to drive them into bankruptcy is to stop using their services.

Another option is to just carry anyway, and screw Cinemark.

Colorado does not have a mandated penalty for ignoring those no guns signs, unless the sign is on a public building with guards and a metal detector.

The most that can happen is getting trespassed by an irate manager.

Not exactly zero aggression principle friendly, I know ... but fuck 'em, I'm tired of seeing people die to this rabbit people crap.

... How did a non-member of law enforcement manage to obtain body armor? It’s a proven fact that every state requires proof of law enforcement credentials ...

Incorrect. In most states in the US, body armor purchase is completely unregulated. As it should be.

Well written, and well thought out! As a fellow LICENSED carrier (female carrier) I agree with EVERYTHING you said, but would like to make a few valid points.

FIRST, the problem with allowing MORE folks to carry is that a vast majority of contemporary US population is too ragingly INCOMPETENT to be as responsible as you and I. They will get the guns, but fail to take the classes to learn proper handling and shooting technique. (hence why so many people DON'T realize that a shot captured by body armor will STILL incapacitate someone, even if only momentarily! Usually long enough to turn the tides on the offender and bring their attack to a screeching halt.) Most people know as much about proper gun safety, and responsibilities as I know about safely milking a cobra for its venom.

SECOND, don't you realize that the first wave of transformation from democracy to totalitarianism is amending any and ALL legal documents to restrict individual liberties. We see that happening now with that rag, THE PATRIOT ACT, AND that new law that was passed allowing police/law to enter your property without a warrant to conduct a search if they suspect national security is at stake...just broad enough to empower the abuse of law abiding citizens. At the SAME time that you wrap a legal straight jacket around law abiding citizens, you need to DISARM them....which is what tighter gun control is effectively doing, as criminals will be armed, but the rest of society are sitting ducks!
While all of this is going on, you need to SELL THIS LOAD OF CRAP to your population under the guise of safety and security! Which they are effectively DOING! Anyone who thinks they are ANY safer than they were on September 10, 2001 is a fool. They USE and EXPLOIT 9/11 to restrict our liberties, and the masses eat it up like pudding. At the same time, you need to try the militia (90% of which are law abiding citizens whose groups HELPED make the US the great place it is!) in the court of public opinion by villainifying them in the media, which they have done.
I am no conspiracy theorist, but it all DOES stink of The New World Order of things...I digress.

David K. M. Klaus:

The North Hollywood armored bank robbers resisted the shock of impact of pistol bullets, shotgun shells, and later rifle bullets just fine without losing their skills to fire their AK-47s. It wasn’t until cops shot them in their unarmored legs from below a vehicle that they went down.

David, the Hollywood bank robbers were professional criminals interested not in victims but in money. They expected to be in a gunfight with police protecting the bank and so prepared for it.

George Hennard was not wearing armor when he went on a shooting spree in the Luby's Cafeteria in Killeen, Texas.

Nor were Eric Harris and Dylan Klebold at Columbine High School, Gang Lu on the campus of the University of Iowa, Seung-Hui Cho at Virginia Tech, Thomas Hamilton at Dunblane Primary School, or Major Nidal Hassan at Fort Hood, Texas.

Apparently you've been ignoring what I've been writing on the topic of preventable massacres for two decades, or you wouldn't be reaching for cases where even a Predator drone might not stop an attack.
